E1 and E2 Investment Visas

There are two types of investment visas available to foreign nationals: the E1 Treaty Trader Visa and the E2 Treaty Investor Visa. To qualify, an individual must engage in substantial economic activity; these are not for casual or part-time investors.

  • An individual who wishes to come to the U.S. to carry on substantial trade, principally between the U.S. and his or her own country, may apply for an E1 visa.
  • Someone who is going to the U.S. to develop and direct the operations of an enterprise in which he or she has invested, or is actively in the process of investing, a substantial amount of capital is welcome to apply for an E2 visa.

Unlike L visas, it is not necessary to maintain a business outside of the U.S. Another benefit to E visas is that they can be renewed every five years without limits.
